This document describes the general terms and conditions (the «General Terms and Conditions») applicable to the use of the services offered by ENTERTAINMENT FOR ALL SAS (“the Services”) within the site www. (the “site”). Any person who wishes to access and/or use the site or services may do so subject to the General Terms and Conditions, together with all other policies and principles that are incorporated herein by reference.
ANY PERSON WHO DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE SITE AND/OR THE SERVICES. IF YOU USE THE SITE AND/OR THE SERVICES, IT IS UNDERSTOOD THAT YOU ACCEPT THESE TERMS AND CONDITIONS.
The User must read, understand and accept all the conditions established in the General Terms and Conditions and in the Privacy Policies, as well as in the other documents incorporated therein by reference, prior to the use of the services.
01 – Capacity
The Services are only available to natural or legal persons, who have the legal capacity to contract. People who do not have that capacity and/or minors may not use the services.
02 – Modifications of the Agreement
ENTERTAINMENT FOR ALL SAS may modify the General Terms and Conditions at any time by making the modified terms public on the Site. All modified terms will be effective the day after they are posted. Said modifications will be communicated by ENTERTAINMENT FOR ALL SAS to the users who access the site. The use of the site and/or its services implies the acceptance of these General Terms and Conditions of use of ENTERTAINMENT FOR ALL SAS
03 – Goods
These Terms and Conditions apply to the marketing of ENTERTAINMENT FOR ALL SAS products, in particular, the kits for the event called T&M Drive In. The acquisition of a kit will entitle one (1) single motor vehicle to enter the event, understood as such; to cars, cars or vans with a maximum capacity of five (5) passengers and with a limited capacity of up to four (4) people maximum per vehicle, according to the regulations of national and local authorities. Once the kit has been purchased, the owner will receive an email with the QR Code, where they can also provide the information of their companions, this will be personal and non-transferable (changes of owner are not accepted). The information to be provided by the owner of the purchase must be: Vehicle license plate, name and surname, identity card, email, address, neighborhood and cell phone of the chosen driver, as well as the personal data of the passengers, namely: name and surname , ID, email, address, neighborhood and cell phone. The owner of the purchase will be the only person authorized to request any change related to the vehicle plates and/or passenger information. These changes may be requested within a maximum period of seventy-two (72) hours before the start date of the event, by sending an email to [email protected]. Payment for the purchase of the aforementioned kits can be made through the PSE system, following the instructions that will appear on your device for this purpose. Whoever makes the purchase through electronic means, may retract it, according to the terms of the law, within five (5) calendar days following the date on which the transaction was made. After this period, returns will not be accepted nor will money be refunded. If within the period established above, the user withdraws, ENTERTAINMENT FOR ALL SAS, will have thirty (30) calendar days to return the money, whose request must be made by the user, through the mail [email protected]attaching the supports of the purchase and the identification document of the person who made it.
04 – Information Privacy
To use the Services offered by ENTRETENIMIENTO PARA TODOS SAS, Users must provide certain personal data. Your personal information is processed and stored on servers or magnetic media that maintain high standards of security and both physical and technological protection. By making the purchase, the user accepts the processing of their personal data, according to the terms of the law. 05 – System or Database Violations
Any action or use of device, software, or other means tending to interfere in both the activities and operations of ENTRETENIMIENTO PARA TODOS SAS and in the offers, descriptions, accounts or databases of ENTRETENIMIENTO PARA TODOS SAS is not permitted. Any interference, attempt or activity that violates or is contrary to the laws on intellectual property rights and/or the prohibitions stipulated in this contract will make it possible for the person responsible for the pertinent legal actions, and the sanctions provided for in this agreement, as well as making it responsible for indemnifying the damages caused.
06 – Responsibility
ENTERTAINMENT FOR ALL SAS will only be liable for manufacturing and/or manufacturing defects of the elements that make up the kit. In no case will it be responsible for the misuse that is made of them.
07 – System failures
ENTERTAINMENT FOR ALL SAS, is not responsible for any damage, harm or loss to the User caused by failures in the system, in the server or on the Internet. ENTERTAINMENT FOR ALL SAS will not be responsible for any virus that could infect the User’s equipment as a result of access, use or examination of its website or as a result of any transfer of data, files, images, texts, or audio contained therein. Users may NOT impute any responsibility or demand payment for lost profits, by virtue of damages resulting from technical difficulties or failures in the systems or on the Internet. ENTERTAINMENT FOR ALL SAS does not guarantee continuous or uninterrupted access and use of its site. The system may eventually be unavailable due to technical difficulties or Internet failures, or due to any other circumstance beyond ENTERTAINMENT FOR ALL SAS; in such cases, efforts will be made to restore it as quickly as possible without any type of responsibility being attributed to it. ENTERTAINMENT FOR ALL SAS will not be responsible for any errors or omissions contained in its website.
08 – Intellectual property. Links
The contents of the screens related to the services of ENTRETENIMIENTO PARA TODOS SAS as well as the programs, databases, networks, files that allow the User to access, are owned by ENTRETENIMIENTO PARA TODOS SAS and are protected by laws and treaties international copyright, trademarks, patents, models and industrial designs. The improper use and total or partial reproduction of said contents are prohibited, unless expressly authorized in writing by ENTERTAINMENT FOR ALL SAS
The Site may contain links to other websites which does not necessarily imply that they are owned or operated by ENTRETENIMIENTO PARA TODOS SAS. Given that ENTRETENIMIENTO PARA TODOS SAS has no control over such sites, it will NOT be responsible for the contents, materials, actions and/or or services provided by them, nor for damages or losses caused by their use, whether caused directly or indirectly. The presence of links to other websites does not imply a partnership, relationship, approval, endorsement of ENTERTAINMENT FOR ALL SAS to said sites and their contents.
09 – Indemnity
The User shall hold harmless ENTRETENIMIENTO PARA TODOS SAS, as well as its subsidiaries, related, controlled and/or controlling companies, officers, directors, successors, administrators, representatives and employees, for any claim initiated by other Users, third parties or by any Organization , related to your activities on the Site, compliance and/or non-compliance with the General Terms and Conditions or other Policies, as well as regarding any violation of laws or rights of third parties.
10 – Jurisdiction and Applicable Law
This agreement will be governed in all its points by the laws in force in the Republic of Colombia.
Any controversy derived from this agreement, its existence, validity, interpretation, scope or compliance, will be submitted to the applicable laws and to the competent Courts of the City of Bogotá and the procedures will be carried out in Spanish.
